These Terms & Conditions govern your use of herworkcollective.com and your purchase and use of products offered under the HERWORK brand.
Please read these Terms & Conditions carefully before placing an order.
By purchasing a product through HERWORK, you agree to these Terms & Conditions.

HERWORK is a brand operated by Back2Health, a registered trade name of Xpertplanning, a sole proprietorship registered in the Netherlands.

References in these Terms to “HERWORK”, “we”, “us” or “our” mean Xpertplanning trading as Back2Health and operating the HERWORK brand.
References to “you”, “your” or “customer” mean the person purchasing or using a HERWORK product.
2. Scope of These Terms
These Terms apply to:

purchases made through herworkcollective.com;

HERWORK digital products;
-
downloadable guides;
-
workbooks;
-
journals;
-
templates;
-
tools;
-
bundles;
-
other digital materials offered by HERWORK.
Additional terms may apply to a particular product or offer if clearly stated before purchase.
If product-specific terms conflict with these general Terms, the product-specific terms apply only to the extent of that conflict.
Mandatory consumer rights that cannot legally be excluded remain unaffected.
3. Eligibility to Purchase
You must be at least 18 years old or otherwise legally capable of entering into a binding contract in your jurisdiction to purchase from HERWORK.
By placing an order, you confirm that:

the information you provide is accurate;

you are legally entitled to use the selected payment method;

you have the legal capacity required to enter into the purchase.
4. Products
HERWORK currently sells digital products.
Unless expressly stated otherwise, no physical product will be shipped.
Product descriptions, images and previews are provided to help explain what you are purchasing.
We aim to describe products accurately. Minor differences in appearance may occur depending on your device, screen, software or display settings.
The content and format included with each purchase will be described on the relevant product page.
5. Ordering
You can place an order through our website by selecting a product and completing the checkout process.
Before submitting your order, you will have the opportunity to review relevant information including the product, price and payment details.
An order is completed once:

you submit the order;
-
payment is successfully authorised or received; and
-
the order is accepted by our ecommerce system.
You will normally receive an electronic order confirmation.
We reserve the right to refuse or cancel an order where reasonably necessary, for example in the event of:

suspected fraud;
-
unauthorised payment;
-
an obvious pricing or technical error;
-
abuse of our website or products;
-
legal or regulatory requirements.
If we cancel a paid order before valid digital delivery, any amount already paid for that cancelled order will be refunded where required.
6. Prices and Taxes
Prices are displayed in the currency shown on the website or during checkout.
Before you complete your purchase, the total amount payable will be displayed.
Applicable taxes will be included, calculated or displayed as required by applicable law and the checkout system.
Your bank, card issuer or payment provider may apply currency conversion costs or other charges. These charges are imposed by the relevant provider and are not controlled by HERWORK.
We may change our prices at any time.
A price change does not affect an order that has already been completed.
7. Payment
Payments may be processed through third-party payment providers, including Stripe.
By submitting payment information, you authorise the relevant payment provider to process the transaction.
HERWORK does not need to receive or store your complete payment card details in order to complete your purchase.
Your transaction may also be subject to the payment provider's own terms and privacy practices.
If payment is declined or cannot be completed, we are not required to provide the purchased product until valid payment has been received.
8. Digital Delivery
HERWORK digital products are supplied electronically.
After successful payment, access may be provided through:

a download link;
-
an order confirmation;
-
a confirmation page;
-
email;
-
another electronic delivery method made available during or after checkout.
You are responsible for providing a correct email address when ordering.
You are also responsible for ensuring that you have a suitable device, internet connection and software capable of opening the relevant digital files.
HERWORK products may commonly be supplied in formats such as PDF or other standard digital formats.
Please download and safely store your purchased files within any download period communicated to you.
A temporary download link does not mean that your licence to use the purchased product expires when the link expires.
9. Right of Withdrawal for Digital Products
Consumers may have a statutory right to withdraw from an online purchase within a specified cooling-off period.
For consumers protected by EU or Dutch consumer law, this period is generally 14 days.
Different or additional rights may apply depending on the mandatory consumer law applicable to you.
Immediate Digital Delivery
HERWORK digital products are designed to be made available immediately after purchase.
When you choose immediate delivery and expressly agree to the applicable digital delivery terms during checkout, you request that delivery begins before the end of any applicable statutory withdrawal period.
You also acknowledge that your statutory right of withdrawal may end once you begin downloading or accessing the digital content, where the law permits this.
HERWORK will provide confirmation of the relevant purchase and digital delivery terms following the transaction where required by law.
Before Download or Access Has Begun
Where you have a statutory withdrawal right and it has not lawfully expired, you may exercise that right within the applicable statutory period.
After Download or Access Has Begun
Once you begin downloading or accessing digital content after giving the required prior consent and acknowledgment, your statutory right of withdrawal may no longer apply.
HERWORK does not offer a separate voluntary refund right simply because you later:
-
change your mind;
-
decide that you no longer want the product;
-
do not use the product;
-
fail to complete the exercises;
-
expected a different personal result.
This does not limit any mandatory legal rights you may have if the digital product is defective, materially different from its description or otherwise fails to comply with applicable consumer law.
10. How to Exercise a Right of Withdrawal
Where a statutory right of withdrawal still applies, you may notify us of your decision to withdraw by an unequivocal statement.

You may also use the model withdrawal form included at the end of these Terms, although use of that form is not mandatory.
Where an online withdrawal function is required by applicable law, HERWORK will make that function available in accordance with those legal requirements.
From 25 June 2026, Dutch rules require an online withdrawal function for relevant online consumer contracts during the period in which withdrawal remains available. Consumers must also still be free to withdraw through other permitted methods.
11. Refunds
Because HERWORK products are digital products capable of immediate delivery, our refund policy differs from a policy for physical goods.
We do not offer voluntary refunds after downloading or accessing a digital product has begun, except where:

applicable consumer law requires a refund;
-
a statutory withdrawal right still legally applies;
-
the digital product is defective or materially does not conform to the contract;
-
we agree otherwise in a specific case.
A request for a refund does not automatically create a right to a refund.
Nothing in these Terms removes or restricts consumer rights that cannot legally be excluded.

12. Problems With a Digital Product

Include sufficient information to identify your order and explain the issue.
If a digital product is defective, inaccessible or does not conform to the agreement, we will handle the issue in accordance with applicable consumer law.
Depending on the circumstances and applicable law, remedies may include bringing the digital content into conformity, replacement access, a proportionate price reduction or termination/refund where legally required.
Dutch consumer law provides statutory remedies where paid digital content or digital services fail to conform to the agreement; these rights cannot simply be replaced by a “no refunds” clause.
13. Licence to Use HERWORK Products
Unless expressly stated otherwise, purchasing a HERWORK digital product gives you a limited, personal, non-exclusive, non-transferable licence to use that product for your own personal use.
Your purchase does not transfer ownership of the intellectual property rights in the product.
You may:

download the product for your own use;
-
save a personal copy;
-
print reasonable copies for your own personal use;
-
complete worksheets or exercises for yourself.
You may not, without our prior written permission:

share purchased files with another person;
-
forward download links;
-
upload products to shared drives, websites or platforms;
-
distribute or reproduce substantial parts of a product;
-
resell a product;
-
sublicense a product;
-
commercially exploit the content;
-
copy the product to create a competing product;
-
remove copyright or brand notices;
-
claim HERWORK content as your own.
Each purchase is intended for one individual user, unless the product page expressly states otherwise.
14. Intellectual Property
All HERWORK content and materials are protected by applicable intellectual property laws.
This includes, where applicable:

written content;
-
frameworks;
-
exercises;
-
worksheets;
-
product designs;
-
graphics;
-
branding;
-
logos;
-
downloadable files;
-
website content;
-
photography;
-
original layouts;
-
product names and materials.
All rights not expressly granted to you remain reserved by their respective owner.
The HERWORK brand, website and products may contain intellectual property owned by Xpertplanning, Back2Health or properly licensed third parties.
Unauthorised copying, distribution or commercial use may result in enforcement of our legal rights.
15. Educational and Informational Purpose
HERWORK products are intended for educational, informational and personal-development purposes.
They are designed to provide frameworks, ideas, exercises and tools that may support personal reflection, self-leadership and action.
HERWORK does not guarantee any particular personal, professional, financial, health or other outcome.
Your results depend on many factors outside our control, including your circumstances, decisions, actions and implementation.
16. No Medical, Psychological, Legal or Financial Advice
Unless explicitly stated otherwise, HERWORK content is not a substitute for professional medical, psychological, psychiatric, legal, financial or other regulated professional advice.
HERWORK does not diagnose, prevent or treat medical or mental-health conditions.
If you require professional support, diagnosis or treatment, you should consult an appropriately qualified professional.
You remain responsible for determining whether any HERWORK exercise or activity is appropriate for your personal circumstances.
17. Personal Responsibility
You are responsible for how you choose to use the information and tools provided through HERWORK.
Nothing in a HERWORK product removes the need to exercise your own judgment.
You are responsible for your own:

decisions;

actions;
-
implementation;
-
wellbeing;
-
professional choices;
-
use of the products.
Where a HERWORK exercise is inappropriate for your circumstances, you should stop or modify the activity and, where appropriate, seek professional guidance.
18. Availability and Technical Issues
We aim to keep our website and digital delivery systems available and functioning properly.
However, we cannot guarantee uninterrupted or error-free availability.
Temporary interruptions may occur because of:

maintenance;

technical failures;
-
hosting issues;
-
internet outages;
-
cybersecurity events;
-
third-party service providers;
-
circumstances outside our reasonable control.
If a technical issue prevents you from accessing a product you validly purchased, contact us and we will take reasonable steps to restore access or otherwise resolve the issue.
19. Third-Party Services
HERWORK uses third-party providers to operate parts of the website and purchase process.
These currently include services such as:
Wix
for website hosting, ecommerce, forms and digital-product infrastructure.
Stripe
for payment processing.
We are not responsible for independent services provided directly by a third party beyond the extent required by applicable law.
Your use of a third-party service may also be governed by that provider's own terms.
20. External Links
HERWORK products, emails or website pages may contain links to third-party websites or resources.
Such links are provided for convenience or information.
Unless expressly stated otherwise, inclusion of a link does not mean that HERWORK controls, endorses or guarantees the third-party website, service or content.
You use third-party websites at your own discretion and should review their applicable terms and privacy information.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Subject to mandatory law, HERWORK is not liable for indirect, incidental or consequential losses arising solely from the use of HERWORK products where such liability may lawfully be excluded.
HERWORK is also not responsible for losses resulting from:

use of a product contrary to its intended purpose;

unauthorised sharing or modification of the product;
-
failure to meet technical requirements within your own equipment or software;
-
decisions made independently by the customer;
-
events outside our reasonable control.
Where applicable law permits liability to be limited, our aggregate contractual liability relating to a particular paid digital product will not exceed the amount you paid to HERWORK for that product.
This limitation does not apply where such limitation would violate mandatory law, including liability that cannot legally be restricted due to fraud, wilful misconduct or other legally protected circumstances.
22. Indemnity for Unlawful Use
To the extent permitted by applicable law, you are responsible for losses reasonably arising from your intentional or unlawful misuse of HERWORK products, including unauthorised commercial distribution or infringement of our intellectual property rights.
This clause does not limit statutory consumer rights.
23. Force Majeure
HERWORK is not responsible for delay or failure to perform an obligation where performance is prevented by circumstances outside our reasonable control.
This may include major internet or infrastructure failures, natural disasters, government action, war, civil disturbance, cyber incidents, widespread service-provider failures or other comparable events.
Any mandatory rights you have under applicable consumer law remain unaffected.
24. Promotions, Discounts and Coupons
HERWORK may occasionally offer:

promotional prices;
-
launch offers;
-
discount codes;
-
limited-time offers;
-
bundled pricing.
Additional conditions may apply and will be communicated where relevant.
Unless stated otherwise:

discount codes have no cash value;
-
discounts cannot be applied retrospectively to completed orders;

multiple promotions cannot necessarily be combined;
-
promotions may be changed or withdrawn before an order is completed.
A completed purchase remains subject to the price accepted at checkout.

Nothing in this complaints process restricts any statutory remedy available to you.

your privacy rights.

27. Changes to Products
We may update or improve digital products from time to time.
Purchasing a product does not automatically entitle you to:

future editions;

future products;
-
additional modules;
-
new bonuses;
-
future versions;
unless this is expressly included in the offer you purchased.
If we make changes to digital content in circumstances where mandatory consumer law grants you specific rights, those statutory rights remain unaffected.
28. Changes to These Terms
We may update these Terms & Conditions where reasonably necessary, including to reflect:

changes to our business;

changes to our products;

changes to our technology or service providers;

improvements in clarity.
The date of the latest version will appear at the top of this page.
The Terms applicable to your purchase are generally the Terms presented to you when your order is placed, subject to mandatory law.
29. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Where possible, the invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it legally effective.
30. No Waiver
If HERWORK does not immediately enforce a provision of these Terms, this does not mean that we permanently waive our right to enforce that provision later.
31. Governing Law
These Terms and contracts entered into through HERWORK are governed by the laws of the Netherlands, unless mandatory consumer law requires otherwise.
If you are a consumer living outside the Netherlands, this choice of Dutch law does not deprive you of mandatory consumer protections that apply to you under the law that cannot contractually be excluded.
32. Jurisdiction
Any dispute will, where possible, first be addressed directly between you and HERWORK.
Where court proceedings are necessary, disputes will be submitted to a competent court in accordance with applicable law.
Nothing in this clause removes a consumer's right to bring proceedings before another court where mandatory consumer-protection rules give the consumer that right.
